1. SCOPE OF APPLICATION:

The following terms and conditions apply to all contractual relationships established between TV-Turm Alexanderplatz Gastronomiegesellschaft mbH – hereinafter referred to as TV-Turm GmbH – and its customers.

Any general terms and conditions of the customer that deviate from the following provisions are expressly rejected. By placing an order, the customer recognizes the GTC in their current version as solely applicable to the contractual relationship.

2. PRODUCTS:

TV-Turm GmbH offers tickets for the ascent, tickets for the virtual reality experience and souvenir items at the Berlin TV Tower box office. Tickets for the ascent, tickets for the virtual reality experience and vouchers are offered via the TV-Turm GmbH webshop. The purchase of a ticket for a visit to the Berlin TV Tower entitles the holder to one admission to the Berlin TV Tower. The ticket loses its validity upon leaving the Berlin TV Tower. The children of ticket holders, provided they have not yet reached the age of 4, are granted free admission to the Berlin TV Tower when accompanied by their parents or guardians.

Upon receipt or receipt of the tickets by the customer, the customer is liable for the ticket in the event of loss, theft or misuse. No reimbursement will be made by TV-Turm GmbH.

3. CONCLUSION OF CONTRACT

1. a) Sale via the Internet

The offer of goods on the TV-Turm GmbH website does not constitute a binding offer by TV-Turm GmbH to conclude a purchase contract. The customer is merely requested by the presentation to submit an offer by placing an order.

1. aa) Purchase of vouchers

When purchasing a voucher, the customer must first enter the value of the voucher. After clicking on the “Continue” button, the customer is taken to the next page. Here the customer must enter the contact details, e-mail address and telephone number. After clicking the “Pay now” button, the customer is taken to a payment overview. After entering the payment method and the individual data, the process can be completed by clicking the “Pay” button.

aaa) Voucher redemption

Vouchers for TV-Turm GmbH can only be redeemed at tv-turm.de or at the box office. Vouchers can only be redeemed for products that are authorized for purchase with vouchers. They can only be redeemed when purchasing tickets and in particular cannot be used to purchase souvenir items or food and drink in the catering areas.

TV Tower vouchers can be redeemed until the end of the third year after purchase of the voucher (“expiration date”).
TV Tower vouchers can be redeemed in whole or in part. Remaining credit can be redeemed at a later date up to the expiration date. If the value of the TV Tower vouchers used is not sufficient for the order, the difference can be settled using another payment method.

TV Tower vouchers cannot be paid out in cash or transferred for value.

Voucher orders can only be canceled by our customer service if the TV Tower voucher has not yet been redeemed.

TV-Turm GmbH is entitled to block the corresponding voucher code (also temporarily) in the event of justified suspicion of fraud or other illegal activities in connection with the purchase or redemption of a TV-Turm voucher.

1. ab) Online ticket purchase

When purchasing tickets online, the customer is directed to a TV-Turm GmbH reservation portal by clicking on the respective ticket offer. The customer now has to choose whether the tickets are for adults, children from 4-14 years or children under 4 years. After selecting the number of persons, the desired period and clicking on the “Continue” button, an overview with alternative ticket offers opens. After clicking the “Continue” button again, a new page appears on which the customer must enter their personal details (name, address if applicable, company if applicable, e-mail address, telephone number). It is also possible to enter a discount coupon or voucher code here. After agreeing to the general terms and conditions, the cancellation conditions and clicking on the “Pay now” button, the customer is taken to the payment page to select the desired payment method. After entering the individual data, the process can be completed by clicking the “Pay” button. Finally, an order overview appears. Here the tickets can be downloaded or added to the Apple Wallet.

The GTC can be read at any time via the Internet browser, printed out or saved on the local computer.

TV-Turm GmbH confirms receipt of the customer’s order by sending an e-mail. This confirmation does not constitute acceptance of the offer by TV-Turm GmbH. It merely informs the customer that the order has been received.

The declaration of acceptance is made by sending the voucher or ticket or an express declaration of acceptance.

The customer can save the text of the contract on the computer by clicking on the right mouse button of the browser or print it out using the browser’s print function. The text of the contract for orders in the Internet store is not accessible to the customer. The text of the contract is saved by TV-Turm GmbH.

1. b) For individual bookings of tickets (up to 19 persons) via the reservation office of TV-Turm GmbH, the customer submits an offer to conclude a contract by providing their personal data for booking the tickets. By confirming the booking and sending the booking confirmation online, the Berlin TV Tower accepts the offer. The booking is thus binding; it is not possible to cancel tickets at fixed times. No guarantee is given for the accuracy of the data provided by the customer.

1. c) Reservations for events shall become binding through two concurring declarations of intent. TV-Turm GmbH is entitled to demand advance payment from the customer. If an advance payment has been agreed, the contract shall only become valid after receipt of the advance payment amount in the account of TV-Turm GmbH.

TV-Turm GmbH reserves the right to terminate the event contract without notice if the agreed advance payment amount has not been received within the period stated on the contract or after a grace period to be set by TV-Turm GmbH.

Option dates are binding for both contracting parties. TV-Turm GmbH reserves the right to rent the reserved premises to another party after expiry of the agreed period without the need for any further notification to the customer on its part.

1. d) As soon as you conclude a contract with us, we may send you promotional emails (e.g. asking for your customer feedback). If you do not wish to receive such e-mails, you can object to receiving them at any time free of charge. Please let us know by sending an e-mail to [email protected].

4. PRICES AND PAYMENT:

1. a) The prices can be found in the webshop under the respective articles.

The prices quoted include statutory VAT.

1. b) In the case of contracts for catering services or events, invoices are payable on site immediately or within 14 days of the invoice date without deduction.

1. c) In the case of bookings via the reservation office, payment shall be made in advance by the customer after conclusion of the contract. When purchasing tickets at the box office of the Berlin TV Tower, payment is made by card, in cash or against a voucher. In the case of online purchases, only the “credit card” (MASTERCARD, VISA) payment methods displayed to the customer during the ordering process are accepted.

1. d) Tickets purchased at fixed times cannot be refunded. Exceptions to this are at the sole discretion of TV-Turm GmbH.
2. e) Any commercial resale of tickets to third parties requires the prior consent of TV-Turm GmbH. Otherwise, TV-Turm GmbH reserves the right to refuse admission.

5. SHIPPING:

The tickets and vouchers purchased online are made available to the customer as print@home tickets. After successfully completing the payment process, the customer receives their ticket or voucher by e-mail and can print it out themselves. They will not be sent by post.

6. REVOCATION POLICY

The consumer has a right of withdrawal for contracts concluded outside of business premises and for distance contracts.

According to Section 312 g (2) No. 9 BGB, the right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services. Accordingly, you have no right of withdrawal for the sale of admission tickets for the ascent of the Berlin TV Tower and events on a fixed date. Every ticket order is therefore binding and obliges you to pay for the tickets ordered.

The following applies to the sale of vouchers to consumers:

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

CONSEQUENCES OF REVOCATION

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

7. CANCELLATIONS

1. a) Tickets and events

Cancellation of booked tickets by the customer is not possible. If the ticket is not used, it will expire. There will be no refund of the purchase price.

1. b) Group bookings with catering services and events

Cancellations by the customer are free of charge up to four weeks before the start of the event at the latest. For cancellations up to 3 weeks before the start of the event, the customer will be charged 30% of all costs listed in the contract.

Special feature for group bookings with catering services: Tim Raue menu

Cancellation or rebooking after conclusion of the contract is not possible. If the customer does not show up, 100% of all listed services will be charged.

The basis for the calculation is the number of persons stated when the contract is concluded. The services invoiced to the customer must be paid by the customer within a period of 14 days to the account of TV-Turm GmbH.

The customer reserves the right to prove that TV-Turm GmbH has suffered no loss at all or a significantly lower loss. The customer agrees that any deposits already made may be offset against any cancellation fees incurred.

In the event of force majeure (epidemic, pandemic, natural disasters, fire, strike, etc.), events of a political or sectarian nature or sales events where the content of the event has not been communicated to TV-Turm GmbH in advance, and in the event that the event poses a risk to TV-Turm GmbH and/or its employees and/or guests, TV-Turm GmbH reserves the right to cancel the order without notice. If the client is in default of payment to TV-Turm GmbH more than once, TV-Turm GmbH shall have the right to terminate the contract with a notice period of 5 days or alternatively to demand advance payment from the client.

Special feature for group bookings with catering services: Tim Raue menu

This addition applies to all bookings and orders for the Tim Raue menu.

The Tim Raue menu comprises a fixed number of courses. It is not possible to change the order of the dishes or to select individual dishes.

The number of persons can be adjusted by a maximum of 5% up to 14 days before the reserved date.

Cancellation or rebooking after conclusion of the contract is not possible. If the customer does not show up, 100% of all listed services will be charged.

1. c) Group bookings without catering services

Cancellations by the customer are free of charge up to one week before the booked date of stay at the latest. Cancellation of booked tickets by the customer at a later date is not possible and the purchase price will not be refunded.

8. SCOPE OF SERVICES AND OBLIGATIONS FOR CONTRACTS CONCERNING CATERING SERVICES AND EVENTS ON THE PREMISES OF TV-TURM GMBH:

The rooms provided must be vacated and returned immediately after the agreed end of the event. Otherwise, TV-Turm GmbH reserves the right to charge an additional half price.

The customer is responsible for setting up and dismantling exhibitions and similar events. Storage of event material is not possible. Any deviating arrangements must be made with the TV-Turm GmbH reservation office and require confirmation. In any case, TV-Turm GmbH excludes all liability for any items or similar stored on its premises, unless the damage is due to gross negligence or willful misconduct on the part of TV-Turm GmbH.

For all events, TV-Turm GmbH reserves the right to relocate events to other premises if necessary. The customer will be informed of this immediately.

The customer must inform TV-Turm GmbH in writing of the final number of participants and any changes to the scope of catering services no later than 5 days before the start of the event. The number of participants stated by then shall be binding and all matters in the contract shall be taken into account 100%.

The customer shall be liable for damage or loss to equipment or inventory caused during an event. This does not apply if damage or loss results from the area of responsibility of TV-Turm GmbH.

It is not permitted to stick anything on the walls or to hammer nails, hooks etc. into the walls, ceilings and floors or furnishings of TV-Turm GmbH. Any damage resulting from violations will be charged to the customer by TV-Turm GmbH and must be paid for by the customer.

TV Turm GmbH shall charge a plate or corkage fee for the serving of food, drinks, etc. brought in by the customer. Any agreements in this regard shall require an express agreement, as shall TV Turm GmbH’s permission for the customer to bring its own food or drinks.

Should faults or defects occur in the technical equipment provided by TV-Turm GmbH, the latter shall immediately take remedial action. A reduction in payment cannot be derived from this. However, the customer’s warranty rights shall remain unaffected. Insofar as TV-Turm GmbH procures technical or other equipment from third parties for the organizer, it shall act on behalf of and for the account of the customer. The customer shall be liable for the careful handling and proper return of such equipment and shall indemnify TV-Turm GmbH against all third-party claims arising from the provision of such equipment. TV-Turm GmbH undertakes to inform the customer in good time of any closing days or days with restricted operation.

The customer shall be responsible for any necessary insurance of exhibition or decoration items brought in. TV-Turm GmbH shall be liable for such items in accordance with the principles of gratuitous safekeeping pursuant to § 690 BGB. Accordingly, TV-Turm GmbH shall only be liable for the care it exercises in its own affairs.

The customer shall be responsible for obtaining any official permits and registrations required to hold the event at his own expense. In particular, the customer shall be obliged to register and pay fees to GEMA and, if a raffle is to be held, to register with the relevant lottery offices of the tax authorities. Any damage or similar resulting from the customer’s failure to do so shall be borne in full by the customer.

A request for changes on the day of the event with regard to furnishings, equipment and seating can only be complied with if an agreement has been reached on the costs involved. This also applies to the catering offer.

The marked emergency exits must not be obstructed or restricted. The staff of TV-Turm GmbH is authorized to issue instructions.

Publications of any kind in which TV-Turm GmbH is mentioned by name require the prior consent of TV-Turm GmbH. If a publication is made without this consent, TV-Turm GmbH reserves the right to cancel the event at short notice.

9. LIABILITY / COMPENSATION FOR DAMAGES:

Unless otherwise stipulated below, claims for damages by the customer are excluded. If the customer asserts claims against legal representatives and/or vicarious agents of TV-Turm GmbH, the above exclusion of liability shall also apply in their favor.

Excluded from this are claims for damages due to injury to life, limb or health and claims for damages arising from the breach of material contractual obligations. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

Also excluded from the exclusion of liability is the liability for damages that are based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.

The provisions of the German Product Liability Act (ProdHaftG) remain unaffected.

TV-Turm GmbH expressly draws the attention of all visitors to the fact that the ring on which the tables in the restaurant are mounted rotates. This area should therefore be entered with particular caution. Parents should pay particular attention to their children.

10. WARRANTY / GUARANTEE:

The statutory warranty rights apply. TV-Turm GmbH does not provide a guarantee.

11. access restrictions / closure:

For the safety of customers, TV-Turm GmbH carries out personal and bag checks and asks for your understanding that all the items listed below may not be taken into the Berlin TV Tower, in particular no bottles, cans or other containers with liquids. Otherwise, TV-Turm GmbH will have to dispose of them for safety reasons. Any claim for return or compensation is expressly excluded.

Access to the Berlin TV Tower is prohibited with:

• Food and beverages of any kind
• Animals of any kind (except assistance dogs)
• baby carriages, skateboards, scooters, bicycles, large items of luggage (max. 45cmx35cmx20cm), suitcases, trolleys, rucksacks, etc.
• Weapons, hazardous substances (e.g. pressurized gas containers, glass bottles, fireworks, etc.)
• Balloons and balls

For security reasons, all visitors to the Berlin TV Tower must consent to a personal and bag check in the access area to the tower. If the guest refuses the check, TV-Turm GmbH may refuse access to the tower.

Smoking is strictly prohibited in the entire building of the Berlin TV Tower.

Minors under the age of 15 may only enter the tower if accompanied by an adult aged 18 or over.

Due to the existing structural conditions in the Berlin TV Tower, wheelchair users and people with current walking disabilities, i.e. people who cannot move around without assistance or without aids such as crutches, etc., are not permitted to enter in order to ensure the safety of visitors in the event of an evacuation. The admission ticket must be kept for the entire duration of the visit and shown to TV-Turm GmbH staff or security personnel on request. It is also required to leave the Berlin TV Tower. Persons who do not have a ticket may be asked to leave the TV Tower.

TV-Turm GmbH reserves the right to close the TV tower or restrict access to the tower at any time and without prior notice in the event of imminent danger, force majeure (epidemic, pandemic, etc.) or for safety reasons.

12. FURTHER CONSUMER INFORMATION CONCERNING DISTANCE SELLING CONTRACTS:

The customer can find the essential characteristics of the goods or services offered and the period of validity of limited offers in the individual product descriptions.

TV-Turm GmbH reserves the right to change the product range and the offer prices of the current product range at any time. Any input errors made when placing the order can be recognized during the final confirmation before checkout and corrected at any time using the delete and change function before sending the order.

TV-Turm GmbH is not subject to any special codes of conduct.

The language available for the conclusion of the contract is exclusively German.

13. DATA PROTECTION:

TV-Turm GmbH processes personal customer data in compliance with the data protection provisions applicable to the contract. The data shall be collected, processed and used in an automated process to the extent necessary for the contractual relationship. The customer shall allow TV-Turm GmbH to forward this data to third parties commissioned with the execution of the contract.

14. VIDEO SURVEILLANCE:

The rooms of the Berlin TV Tower are monitored by video technology and video recordings are made and stored. The legal regulations (e.g. Berlin Data Protection Act) in the currently valid version are always observed.

15. PROHIBITION OF ASSIGNMENT AND PLEDGING

The assignment or pledging of claims or rights to which the customer is entitled against TV-Turm GmbH shall be excluded without the consent of TV-Turm GmbH, unless the customer can prove a legitimate interest in the assignment or pledging. This shall not apply if the customer is a consumer.

16. PLACE OF JURISDICTION / CHOICE OF LAW:

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and TV-Turm GmbH shall be the registered office of TV-Turm GmbH, unless the customer is a consumer. The applicable law is that of the Federal Republic of Germany. The mandatory consumer protection provisions of the country in which the customer has his habitual residence are excluded from the choice of law. The UN Convention on Contracts for the International Sale of Goods shall not apply.

17. PLACE OF FULFILLMENT:

If the customer is an entrepreneur, the place of performance for all disputes arising from this contract shall be Berlin/Germany for both contracting parties.
