TERMS AND CONDITIONS OF TV-TURM ALEXANDERPLATZ GASTRONOMIEGESELLSCHAFT MBH <\/span><\/h2>

\u00a0<\/p>

1. SCOPE OF APPLICATION:<\/strong> <\/span><\/p>

The following terms and conditions apply to all contractual relationships established between TV-Turm Alexanderplatz Gastronomiegesellschaft mbH \u2013 hereinafter referred to as TV-Turm GmbH \u2013 and its customers.<\/span><\/p>

Any terms and conditions of the customer that deviate from the following provisions are expressly rejected. By placing an order, the customer acknowledges that the current version of these terms and conditions is solely applicable to the contractual relationship.<\/span><\/p>

2. PRODUCTS:<\/strong> <\/span><\/p>

TV-Turm GmbH offers tickets for the ascent, tickets for the virtual reality \u2013 experience and souvenirs at the box office of the Berlin TV Tower. Tickets for the ascent, tickets for the virtual reality experience and vouchers are available via the TV-Turm GmbH online shop. The purchase of a ticket to visit the Berlin TV Tower entitles the holder to a single entry to the Berlin TV Tower. The ticket loses its validity upon leaving the Berlin TV Tower. Children of ticket holders who have not yet reached the age of 4 are granted free entry to the Berlin TV Tower when accompanied by their parents or guardians.<\/span><\/p>

From the moment the customer receives the tickets, they are liable for the ticket in the event of loss, theft or misuse. No refund will be issued by TV-Turm GmbH.<\/span><\/p>

3. CONCLUSION OF CONTRACT<\/strong> <\/span><\/p>

\u00a0<\/p>

a) Sale via the Internet<\/strong> <\/span><\/p>

The presentation of goods on the TV-Turm GmbH website does not constitute a binding offer by TV-Turm GmbH to conclude a sales contract. The presentation merely invites the customer to make an offer by placing an order. A contract is only concluded upon acceptance by TV-Turm GmbH.<\/span><\/p>

aa) Purchase of vouchers<\/strong> <\/span><\/p>

When purchasing a voucher, the customer must first enter the value of the voucher. After clicking the \u201cContinue\u201d button, the customer is taken to the next page. Here, the customer must provide their contact details, email address and telephone number. After clicking the \u201cPay now\u201d button, the customer is taken to a payment summary. After entering the payment method and personal details, the transaction can be completed by clicking the \u201cPay\u201d button.<\/span><\/p>

aaa) Redeeming vouchers<\/strong> <\/span><\/p>

Vouchers for TV-Turm GmbH can only be redeemed on tv-turm.de or at the box office. Vouchers are only valid for products that are authorised for purchase using vouchers. They can only be used when purchasing tickets and, in particular, not for the purchase of souvenirs or food and drink in the catering areas.<\/span><\/p>

TV-Turm \u2013 vouchers are valid until the end of the third year following the date of purchase (\u201cexpiry date\u201d).<\/span><\/p>

TV Tower \u2013 vouchers may be redeemed in full or in part. Any remaining credit may be redeemed at a later date up to the expiry date. Should the value of the TV Tower \u2013 vouchers used not be sufficient to cover the order, the difference may be settled using another payment method.<\/span><\/p>

TV \u2013 Turm \u2013 vouchers cannot be exchanged for cash or transferred for value.<\/span><\/p>

Cancellation of voucher orders can only be made by our customer service team if the TV-Turm voucher has not yet been redeemed. Statutory rights of withdrawal remain unaffected.<\/span><\/p>

TV-Turm GmbH is entitled to block the relevant voucher code (including temporarily) in the event of a justified suspicion of fraud or other unlawful activities in connection with the purchase or redemption of a TV-Turm \u2013 voucher . <\/span><\/p>

\u00a0<\/p>

ab) Online ticket purchase<\/span><\/strong><\/p>

When purchasing tickets online, the customer is redirected to a TV-Turm GmbH booking portal by clicking on the relevant ticket offer. The customer must now select whether the tickets are for adults, children aged 4\u201314 or children under 4. After selecting the number of people, the desired time slot and clicking the \u201cContinue\u201d button, an overview of alternative ticket offers will appear. After clicking the \u201cContinue\u201d button again, a new page appears where the customer must enter their personal details (name, address if applicable, company name if applicable, email address, telephone number). It is also possible to enter a discount voucher or voucher code here.\u00a0 <\/span>After agreeing to the General Terms and Conditions and the Cancellation Policy and clicking the \u201cPay now\u201d button, the customer is taken to the payment page to select their preferred payment method. Once the relevant details have been entered, the transaction can be completed by clicking the \u201cPay\u201d button. An order summary then appears. Here, the tickets can be downloaded or added to Apple Wallet.<\/span><\/p>

The Terms and Conditions can be read, printed or saved to the local computer at any time via the internet browser.<\/span><\/p>

TV-Turm GmbH confirms receipt of the customer\u2019s order by sending an email. This confirmation does not yet constitute acceptance of the offer by TV-Turm GmbH. It merely informs the customer that the order has been received.<\/span><\/p>

Acceptance is confirmed by sending the voucher or ticket, or by an explicit declaration of acceptance.<\/span><\/p>

The customer may save the contract text to their computer by right-clicking in the browser or print it out using the browser\u2019s print function. The contract text for orders placed via the online shop is not accessible to the customer. The contract text is stored by TV-Turm GmbH.<\/span><\/p>

b)<\/strong> For individual ticket bookings (up to 19 people) made via the TV-Turm GmbH booking office, the customer makes an offer to conclude a contract by providing their personal details for the booking of the tickets. By confirming the booking and sending the booking confirmation online, the Berlin TV Tower accepts the offer. The booking is therefore binding; cancellation of tickets at fixed times is not possible. No guarantee is given as to the accuracy of the data provided by the customer.<\/span><\/p>

c)<\/strong> Reservations for events become binding upon the exchange of two matching declarations of intent. TV-Turm GmbH is entitled to require an advance payment from the customer. If an advance payment has been agreed, the contract shall only become valid upon receipt of the advance payment amount in the account of TV-Turm GmbH.<\/span><\/p>

TV-Turm GmbH reserves the right to terminate the event contract without notice if the agreed advance payment has not been received within the period specified in the contract or within a grace period to be set by TV-Turm GmbH.<\/span><\/p>

Option dates are binding on both contracting parties. TV-Turm GmbH reserves the right to let the reserved premises to other parties after the agreed deadline has expired, without the need to notify the customer further. <\/span><\/p>

4. PRICES AND PAYMENT:<\/strong> <\/span><\/p>

a)<\/strong> Prices are listed in the web shop alongside the respective items.<\/span><\/p>

The prices quoted include statutory VAT.<\/span><\/p>

b)<\/strong> For contracts relating to catering services or events, invoices are payable on site immediately or within 14 days of the invoice date without deduction.<\/span><\/p>

c)<\/strong> For bookings made through the booking office, payment must be made in advance by the customer upon conclusion of the contract. When purchasing tickets at the Berlin TV Tower box office, payment is by card, in cash or by voucher. For online purchases, only the payment methods displayed to the customer during the ordering process, namely \u201ccredit cards\u201d (MASTERCARD, VISA), are accepted.<\/span><\/p>

d)<\/strong> Tickets purchased for specific times cannot be refunded. Exceptions to this are at the sole discretion of TV-Turm GmbH.<\/span><\/p>

e)<\/strong> The commercial resale of tickets to third parties requires the prior consent of TV-Turm GmbH. Otherwise, TV-Turm GmbH reserves the right to refuse admission.<\/span><\/p>

\u00a0<\/p>

5. DELIVERY:<\/strong> <\/span><\/p>

Tickets and vouchers purchased online are made available to the customer as print@home tickets. Once the payment process has been successfully completed, the customer will receive their ticket or voucher by email and can print it out themselves. Tickets will not be sent by post.<\/span><\/p>

6. CANCELLATION POLICY<\/strong> <\/span><\/p>

In the case of contracts concluded outside business premises and distance contracts, the consumer is entitled to a right of withdrawal.<\/span><\/p>

Pursuant to Section 312g(2)(9) of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities if the contract specifies a specific date or period for the provision of the service. Consequently, you do not have a right of withdrawal for the sale of tickets for access to the Berlin TV Tower and events on a fixed date. Any order of tickets from is therefore binding and obliges you to pay for the tickets ordered.<\/span><\/p>

The following applies to the sale of vouchers to consumers:<\/span><\/p>

\u00a0<\/p>

RIGHT OF WITHDRAWAL<\/span><\/strong><\/p>

You have the right to withdraw from this contract within fourteen days without giving any reason.<\/span><\/p>

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.<\/span><\/p>

To exercise your right of withdrawal, you must inform us<\/span><\/p>

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory. <\/span><\/p>

To exercise your right of withdrawal, you may also use the electronic withdrawal function provided on our website.<\/span><\/p>

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.<\/span><\/p>

\u00a0<\/p>

CONSEQUENCES OF WITHDRAWAL<\/span><\/strong><\/p>

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us ), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.<\/span><\/p>

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.<\/span><\/p>

You must return or hand over the goods to us without delay and in any event no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods.<\/span><\/p>

You will only be liable for any diminished value of the goods if this is attributable to handling of the goods that goes beyond what is necessary to establish their nature, characteristics and functioning.<\/span><\/p>

End of the cancellation policy<\/span><\/em><\/p>

7. CANCELLATIONS<\/strong> <\/span><\/p>

a) Tickets and events<\/strong> <\/span><\/p>

The customer cannot cancel booked tickets. If the ticket is not used, it will lapse. No refund of the purchase price will be made.<\/span><\/p>

b) Group bookings including catering and events<\/strong> <\/span><\/p>

Cancellations made by the customer are free of charge up to four weeks before the start of the event. For cancellations made up to 3 weeks before the start of the event, the customer will be charged 30% of all services listed in the contract; for cancellations made up to 2 weeks before the start of the event, 75%; and for cancellations made up to 13 days before the start of the event, 100% of all listed services will be charged.<\/span><\/p>

The calculation is based on the number of people specified at the time the contract was concluded. The customer must settle the charges for the services within 14 days, with payment to be credited to the account of TV-Turm GmbH.<\/span><\/p>

The customer reserves the right to prove that TV-Turm GmbH has incurred no loss at all or a significantly lower loss. The customer agrees that any advance payments already made may be offset against any cancellation fees incurred.<\/span><\/p>

In the event of force majeure (epidemics, pandemics, natural disasters, fire, strikes, etc.), in the case of events of a political or sectarian nature or sales events where the content of the event has not been communicated to TV-Turm GmbH in advance, as well as in the event that the event poses a threat to TV-Turm GmbH and\/or its employees and\/or guests, TV-Turm GmbH reserves the right to cancel the order with immediate effect. If the client is in arrears with payments to TV-Turm GmbH on more than one occasion following a reminder, TV-Turm GmbH shall be entitled to terminate the contract with five days\u2019 notice or, alternatively, to require the client to pay in advance.<\/span><\/p>

Special note regarding group bookings with catering: Tim Raue menu<\/span><\/p>

Cancellation or rebooking after the contract has been concluded is not possible. If the customer fails to attend, 100% of all listed services will be invoiced.<\/span><\/p>

The basis for calculation is the number of persons specified at the time the contract was concluded. The services invoiced to the customer must be settled by the customer within a period of 14 days, payable to the account of TV-Turm GmbH.<\/span><\/p>

The customer reserves the right to prove that TV-Turm GmbH has incurred no loss at all or a significantly lower loss. The customer agrees that any deposits already paid may be offset against any cancellation fees incurred.<\/span><\/p>

In the event of force majeure (epidemic, pandemic, natural disasters, fire, strike, etc.), for events of a political or sectarian nature or sales events where the content of the event has not been communicated to TV-Turm GmbH in advance, as well as in the event that the event poses a threat to TV-Turm GmbH and\/or its employees and\/or guests, TV-Turm GmbH reserves the right to cancel the order without notice. Special provision for group bookings including catering: Tim Raue Menu<\/span><\/p>

This addendum applies to all bookings and orders of the Tim Raue menu.<\/span><\/p>

The Tim Raue menu comprises a fixed number of courses. It is not possible to change the order of the dishes or to select individual dishes.<\/span><\/p>

The number of guests may be adjusted by a maximum of 5% up to 14 days before the reserved date.<\/span><\/p>

Cancellation or rebooking after the contract has been concluded is not possible. In the event of a no-show, 100% of all listed services will be charged. <\/span><\/p>

c) Group bookings without catering services<\/strong> <\/span><\/p>

Cancellations by the customer are free of charge up to one week before the booked date of the stay. Later cancellation of booked tickets by the customer is not possible and no refund of the purchase price will be made.<\/span><\/p>

\u00a0<\/p>

8. SCOPE OF SERVICES AND OBLIGATIONS FOR CONTRACTS RELATING TO CATERING SERVICES AND EVENTS ON THE PREMISES OF TV-TURM GMBH:<\/strong> <\/span><\/p>

The rooms provided must be cleared and returned immediately after the agreed end of the event. Otherwise, TV-Turm GmbH reserves the right to charge an additional half-day\u2019s fee\u00a0 <\/span>.<\/span><\/p>

The customer is responsible for setting up and dismantling exhibitions and similar events. It is not possible to store event materials. Any deviating arrangements must be made with the TV-Turm GmbH booking office and require confirmation. In any event, TV-Turm GmbH excludes all liability for any items or similar stored on its premises, provided that the damage is not due to gross negligence or wilful<\/span><\/p>

breach of contract on its part or on the part of its legal representative or vicarious agent.<\/span><\/p>

For all events, TV-Turm GmbH reserves the right to relocate events to other premises if necessary. The customer will be informed of this immediately.<\/span><\/p>

The customer must notify TV-Turm GmbH in writing of the final number of participants and any changes to the catering services no later than 5 days before the start of the event. The number of participants specified by that time is binding and all terms of the contract will be honoured in full.<\/span><\/p>

The customer is liable for any damage to or loss of facilities or inventory caused during an event. This does not apply if the damage or loss results from the area of responsibility of TV-Turm GmbH.<\/span><\/p>

It is not permitted to affix anything to walls, or to hammer nails, hooks, etc. into walls, ceilings, floors or furnishings belonging to TV-Turm GmbH. TV-Turm GmbH will charge the customer for any damage resulting from breaches of this rule, and the customer must settle such charges.<\/span><\/p>

For the serving of food, drinks, etc., brought in by the customer, TV-Turm GmbH charges a plate or corkage fee. Any arrangements regarding this require an express agreement, as does the authorisation from TV-Turm GmbH for the customer to bring in their own food or drinks.<\/span><\/p>

Should malfunctions or defects occur in the technical equipment provided by TV-Turm GmbH, the latter shall remedy the situation without delay. This shall not give rise to a reduction in payment. The customer\u2019s warranty rights remain unaffected, however. Insofar as TV-Turm GmbH procures technical or other equipment from third parties on behalf of the organiser, it acts in the name and on behalf of the customer. The customer is liable for the careful handling and proper return of the equipment and indemnifies TV-Turm GmbH against all claims by third parties arising from the provision of such equipment. TV-Turm GmbH undertakes to inform the client in good time of any closure days or days with restricted operations.<\/span><\/p>

Any necessary insurance for exhibition or decorative items brought onto the premises is the responsibility of the customer. TV-Turm GmbH shall be liable for such items in accordance with the principles of gratuitous custody pursuant to Section 690 of the German Civil Code (BGB). Accordingly, TV-Turm GmbH shall only be liable for the standard of care it would apply in its own affairs.<\/span><\/p>

The customer must obtain any official permits and registrations required for the event at their own expense. In particular, the customer is responsible for registering with and paying fees to GEMA, as well as, in the event of a raffle being held in accordance with the German Lottery Act ( ), for registering with the relevant lottery offices of the tax authority. Any damage or similar resulting from any failure on the part of the customer shall be borne in full by the customer.<\/span><\/p>

Requests for changes on the day of the event regarding the layout, equipment and seating can only be accommodated if an agreement has been reached regarding the costs involved. This also applies to the catering provision.<\/span><\/p>

The marked emergency exits must not be obstructed or blocked. The staff of TV-Turm GmbH are authorised to issue instructions.<\/span><\/p>

Publications of any kind in which TV-Turm GmbH is mentioned by name require the prior consent of TV-Turm GmbH. Should a publication appear without this consent, TV-Turm GmbH reserves the right to cancel the event at short notice.<\/span><\/p>

\u00a0<\/p>

9. LIABILITY \/ COMPENSATION:<\/strong> <\/span><\/p>

Unless otherwise specified below, claims for damages by the customer are excluded. If the customer asserts claims against legal representatives and\/or vicarious agents of TV-Turm GmbH, the above exclusion of liability shall also apply in their favour.<\/span><\/p>

Excluded from this are claims for damages arising from injury to life, limb or health, and claims for damages arising from a breach of material contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract.<\/span><\/p>

Also excluded from the exclusion of liability is liability for damages resulting from an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.<\/span><\/p>

The provisions of the Product Liability Act (ProdHaftG) remain unaffected.<\/span><\/p>

TV-Turm GmbH expressly draws the attention of all visitors to the fact that the ring on which the tables in the restaurant are mounted rotates. Please therefore exercise particular caution when entering this area. Parents are asked to keep a close eye on their children.<\/span><\/p>

\u00a0<\/p>

10. WARRANTY \/ GUARANTEE:<\/strong> <\/span><\/p>

The statutory rights regarding liability for defects apply. TV-Turm GmbH does not provide any warranty.<\/span><\/p>

\u00a0<\/p>

11. ACCESS RESTRICTIONS \/ CLOSING:<\/strong> <\/span><\/p>

For the safety of visitors, TV-Turm GmbH carries out body and bag searches and asks for your understanding that none of the items listed below may be taken into the Berlin TV Tower, in particular no bottles, cans or other containers holding liquids. Otherwise, TV-Turm GmbH must dispose of them for safety reasons. Any claim for return or compensation is expressly excluded.<\/span><\/p>

Access to the Berlin TV Tower is prohibited with:<\/span><\/p>

\u2022 Food and drink of any kind<\/span><\/p>

\u2022 Animals of any kind (except assistance dogs)<\/span><\/p>

\u2022 Prams, skateboards, scooters, bicycles, large items of luggage (max. 45cm x 35cm x 20cm), suitcases, trolleys, rucksacks, etc.<\/span><\/p>

\u2022 Weapons, hazardous substances (e.g. gas canisters, glass bottles, fireworks, etc.)<\/span><\/p>

\u2022 Balloons and balls<\/span><\/p>

For safety reasons, all visitors to the Berlin TV Tower must consent to a personal and bag search in the entrance area to the tower. If a visitor refuses the search, TV-Turm GmbH may refuse access to the tower.<\/span><\/p>

Smoking is strictly prohibited throughout the entire Berlin TV Tower building.<\/span><\/p>

Minors under the age of 15 are only permitted access to the Tower if accompanied by an adult aged 18 or over.<\/span><\/p>

Due to the structural conditions of the Berlin TV Tower, and in order to ensure visitor safety in the event of an evacuation, access is not permitted for wheelchair users and persons with a current walking disability, i.e. persons who cannot move about without assistance or without aids such as crutches etc. Further information and background details can be found here.<\/span><\/p>

The admission ticket must be retained for the entire duration of the visit and presented on request to staff of TV-Turm GmbH or security personnel. It is also required to leave the Berlin TV Tower. Visitors without a ticket may be asked to leave the TV Tower.<\/span><\/p>

TV-Turm GmbH reserves the right to close the TV Tower at any time and without prior notice, or to restrict access to the tower, in the event of imminent danger, force majeure (epidemic, pandemic, etc.) or for safety reasons.<\/span><\/p>

Regular closing times for renovations etc. can be viewed on the website www.tv-turm.de.<\/span><\/p>

\u00a0<\/p>

12. FURTHER CONSUMER INFORMATION REGARDING DISTANCE SALE CONTRACTS:<\/strong> <\/span><\/p>

Customers can find the key features of the goods or services offered, as well as the validity period of limited-time offers, in the individual product descriptions.<\/span><\/p>

TV-Turm GmbH reserves the right to change the product range and the prices of the current range at any time. Any input errors made when placing the order can be identified during the final confirmation at before proceeding to checkout and can be corrected at any time using the delete and edit functions before the order is submitted.<\/span><\/p>

TV-Turm GmbH is not subject to any specific codes of conduct.<\/span><\/p>

The language available for the conclusion of the contract is exclusively German.<\/span><\/p>

13. DATA PROTECTION:<\/strong> <\/span><\/p>

TV-Turm GmbH processes personal data in compliance with the applicable data protection regulations. The details of data processing are set out in the privacy policy, available at: https:\/\/tv-turm.de\/datenschutz\/.<\/span><\/p>

14. PROHIBITION ON ASSIGNMENT AND PLEDGING<\/strong> <\/span><\/p>

The assignment or pledging of claims or rights to which the customer is entitled against TV-Turm GmbH is excluded without the consent of TV-Turm GmbH, unless the customer can demonstrate a legitimate interest in the assignment or pledging. This does not apply if the customer is a consumer.<\/span><\/p>

\u00a0<\/p>

15. JURISDICTION \/ GOVERNING LAW:<\/strong> <\/span><\/p>

For all disputes arising from the contractual relationship between the customer and TV-Turm GmbH, the place of jurisdiction shall be the registered office of TV-Turm GmbH, provided that the customer is not a consumer. The applicable law is that of the Federal Republic of Germany. The mandatory consumer protection provisions of the country in which the customer has their habitual residence are excluded from the choice of law. The UN Convention on Contracts for the International Sale of Goods shall not apply.<\/span><\/p>

17. PLACE OF PERFORMANCE:<\/strong> <\/span><\/p>

Where the customer is a business, the place of performance for all disputes arising from this contract for both contracting parties is Berlin, Germany.<\/span><\/p>

\u00a0<\/p>
